StarTrip App – Terms & Conditions

Welcome to StarTrip, a technology platform operated by StarTrip Technologies FZ-LLC, a company incorporated in Dubai, United Arab Emirates (“StarTrip”).

In Papua New Guinea, the StarTrip platform is operated under licence by Khoco Limited, StarTrip’s authorised local representative.

 

By downloading, accessing, or using the StarTrip app, website, kiosk, or related services (collectively, the “Services”), you agree to be bound by these Terms & Conditions (“Terms”).

If you do not agree, you must not use the Services.

 

 

 

1. Scope of Services

 

 

StarTrip provides a digital technology platform that connects users with independent third-party service providers for on-demand services, including but not limited to:

 

  • Ride-hailing platform

 

StarTrip itself does not provide transportation, delivery, or security services and is not a carrier, agent, or employer of any service provider. Each driver or service provider is an independent contractor.

 

 

 

2. Acceptance of Terms

 

 

By registering or using the Services, you:

 

  • Confirm that you are at least 18 years old and legally capable of entering into binding agreements;

  • Agree to comply with these Terms and all applicable laws of Papua New Guinea; and

  • Consent to receive communications from StarTrip and its partners electronically (including email, SMS, phone, or in-app notifications).

 

 

 

 

3. User Responsibilities

 

 

You agree to:

 

  • Provide complete and accurate information during registration and booking;

  • Use the Services only for lawful purposes;

  • Refrain from fraudulent, abusive, or disruptive behaviour;

  • Respect drivers, customers, and property; and

  • Accept full responsibility for your safety and belongings during any trip or delivery.

 

 

StarTrip reserves the right to suspend or terminate access for any misuse of the platform.

 

 

 

4. Payments, Wallets & Fees

 

 

4.1 Pricing and Authorisation

All fares, service fees, and surcharges are displayed at the time of booking. By confirming a trip or order, you authorise StarTrip (or its appointed payment processors) to process payment using your chosen method.

 

4.2 Cash Payments

Where cash payments are permitted, such payments are deemed to be collected on behalf of StarTrip by the driver as StarTrip’s authorised agent.

 

4.3 Driver Wallet Balances

Drivers must maintain a positive in-app wallet balance to accept new rides or orders. Wallet funds are applied toward StarTrip’s service commissions and other authorised deductions.

 

4.4 Top-Ups and Trust Handling

Wallet top-ups made via cash, bank, or mobile-money deposit to Khoco Limited or authorised agents are held in trust for StarTrip. These funds are not deposit accounts, do not earn interest, and may not be withdrawn except for StarTrip-approved transactions.

 

4.5 Remittance and Reconciliation

Khoco reconciles and remits wallet and fare collections to StarTrip in accordance with StarTrip’s financial procedures and applicable tax laws, including required 17 % withholding tax remittance to the Internal Revenue Commission (IRC).

 

4.6 Refunds and Adjustments

Refunds or promotional credits are discretionary and processed in accordance with StarTrip’s refund policies.

 

 

 

5. Promotions, Referrals & Marketing

 

 

5.1 Global Promotions

StarTrip may run app-based promotions, referral programs, or coupon campaigns globally at its discretion. StarTrip funds such campaigns and may modify or cancel them at any time.

 

5.2 Local Promotions

Local marketing activities, events, or referral drives within Papua New Guinea may be executed by Khoco Limited, acting under StarTrip’s written authorisation. The cost of such campaigns is treated as Khoco’s local operational expense.

 

5.3 Participation

Participation in promotions is optional and subject to the terms displayed within the app or website at the time of participation.

 

 

 

6. Data & Privacy

 

 

6.1 Data Collection

StarTrip may collect personal information such as your name, contact details, payment information, and trip data to operate and improve the Services.

 

6.2 Data Control

All platform data and aggregated analytics are owned by StarTrip Technologies FZ-LLC. Khoco Limited processes such data locally in accordance with StarTrip’s privacy standards and Papua New Guinea law.

 

6.3 Data Sharing

Data may be shared only with:

 

  • Payment processors and technical service providers;

  • Affiliates or marketing partners assisting with operations;

  • Law-enforcement or regulatory agencies when legally required.

 

 

6.4 Security

StarTrip uses reasonable technical and organisational measures to protect data but cannot guarantee absolute security against unauthorised access.

 

 

 

7. Intellectual Property

 

 

All rights, title, and interest in the StarTrip platform, app, website, software, trademarks, logos, and content (collectively, the “StarTrip IP”) are the exclusive property of StarTrip Technologies FZ-LLC (UAE).

 

Khoco Limited is granted a limited licence to use the StarTrip IP solely for authorised operations in Papua New Guinea.

Users receive a personal, non-exclusive, non-transferable, revocable licence to use the app for lawful purposes only.

 

You may not copy, reproduce, distribute, reverse-engineer, or create derivative works from any part of the StarTrip IP.

 

 

 

8. Liability & Disclaimers

 

 

  • The Services are provided “as is” without warranties of any kind, express or implied.

  • StarTrip and Khoco disclaim all liability for any accidents, delays, losses, injuries, property damage, or death arising from driver, customer (rider) or third-party actions.

  • StarTrip does not guarantee the availability, punctuality, or safety of any service provider.

  • To the maximum extent permitted by law, StarTrip and Khoco shall not be liable for indirect, incidental, special, or consequential damages.

 

 

 

 

9. Account Suspension or Termination

 

 

StarTrip may suspend or permanently terminate a user or driver account, without notice, if:

 

  • These Terms are violated;

  • Fraudulent or illegal activity is detected;

  • Required wallet balances or reconciliations are not maintained; or

  • Continued participation poses reputational or operational risk.

 

 

Termination may result in forfeiture of access to the Services, wallet balances, and promotional credits.

 

 

 

10. Governing Law & Dispute Resolution

 

 

10.1 These Terms and any disputes arising hereunder shall be governed by the laws of Papua New Guinea.

10.2 Parties shall first attempt to resolve disputes through StarTrip’s internal mediation process.

10.3 If unresolved within 30 days, the dispute shall be referred to binding arbitration in Singapore under the Singapore International Arbitration Centre (SIAC) Rules, conducted in English, before one arbitrator.

10.4 The arbitral award shall be final and binding on both Parties.

 

 

 

11. Amendments

 

 

StarTrip may modify these Terms from time to time. Updates will be published in-app or on the website. Continued use of the Services after any modification constitutes acceptance of the revised Terms.
